Michigan Law: Four Degrees of Criminal Sexual Conduct

There are a total of four degrees of criminal sexual conduct in Michigan, as defined under the Michigan Penal Code §750.520b-e. These statutes cover sexual assault offenses against adult victims, as well as against victims who are minors. The severity of the offense depends on a combination of factors. Some of the various factors that are considered, besides the victim's age, include the following:

  • Whether force or coercion was used

  • Whether the victim was a relative or household member

  • Whether the offender was in a position of authority over the victim

  • Whether the victim was physically or mentally incapacitated in any way

  • Whether a weapon was used

  • Whether the victim was injured

  • Whether someone else aided in the offense

  • Whether another felony was committed at the time of the offense

The offense of criminal sexual conduct is much more complex than this, so it is important that you speak with a knowledgeable attorney when you are charged with this crime.   • First Degree: Life prison term or a prison term for any number of years

  • Second Degree: Up to 15 years in prison

  • Fourth Degree: Up to 2 years in prison and/or maximum fine of $500
